Terms of Service

SparkPoint Appliance Repair & Installation (the "Company"), legally registered as SparkPoint Appliance Repair LLC, operates this website and provides appliance repair and installation services.

1. Acceptance of Terms

By accessing our website or booking a service, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, do not use our website or services.

2. Use of Website

Permission is granted to temporarily download one copy of the materials on our website for personal, non-commercial use only. You may not:

  • modify or copy the materials;
  • use the materials for any commercial purpose or public display without written consent;
  • attempt to decompile or reverse engineer any software contained on the website;
  • remove any copyright or proprietary notations;
  • "mirror" or republish the materials on another server.

This permission automatically terminates if you violate any of these restrictions.

3. Service Terms (General)

3.1 Scheduling & Arrival

Appointments are scheduled within a confirmed time window (arrival window). You are responsible for ensuring the technician can access the appliance and the service location during the scheduled window.

3.2 Customer Responsibilities

You agree to:

  • provide safe and reasonable access to the appliance and work area;
  • ensure utilities needed for diagnosis/repair (electricity, water, gas where applicable) are available;
  • secure pets and provide a safe working environment;
  • disclose known issues that may affect service (leaks, electrical hazards, prior repairs, etc.).

3.3 Estimates & Authorization

After diagnosis, we may provide an estimate. No additional parts or labor beyond the diagnostic will be performed or ordered without your approval.

3.4 Appliance Movement

Some jobs may require moving appliances. You acknowledge that moving appliances may involve risk to floors, walls, cabinetry, plumbing connections, or surrounding structures. To the extent permitted by law, the Company is not liable for incidental cosmetic damage that may occur during necessary appliance movement.

3.5 Parts & Warranty

Any warranty applies only to the specific parts repaired or replaced by the Company, for the period stated on your invoice/work order. Warranty is not transferable. Warranty does not cover misuse, abuse, improper installation by others, normal wear and tear, or unrelated failures.

3.6 Exclusions

To the extent permitted by law, the Company is not responsible for:

  • water damage, mold, corrosion, or pre-existing conditions;
  • food spoilage or loss of contents;
  • indirect, special, incidental, or consequential damages.

3.7 Additional Labor / Additional Technician

Some repairs may require additional labor, specialized tools, or an additional technician. If additional charges apply, we will communicate them to you before proceeding, and you may decline.

4. Payments, Deposits, Cancellations, and Parts Returns

All booking deposits, cancellations/reschedules, no-show/no-access situations, diagnostic/service call charges, payment timing, card-on-file authorization, parts policy (including returns), and labor payment terms are governed by our Booking & Payment Policy (the "Policy"), which is incorporated into these Terms by reference. By booking a service, you agree to follow the Policy.

If there is any conflict between these Terms and the Policy, the Policy controls for all payment, cancellation, and parts-related matters.

5. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third-party sites.

6. Disclaimer

Our website materials and services are provided "as is." The Company disclaims all warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall the Company, its owners, employees, or contractors be liable for indirect or consequential damages (including lost profits, data loss, or food spoilage). Our maximum liability shall not exceed the total amount paid by you for the specific service giving rise to the claim.

8. Revisions & Updates

We may update these Terms at any time. Your continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law rules.

10. SMS Communications

By providing your phone number, you agree that the Company may send service-related SMS notifications. Messaging frequency may vary, and standard message & data rates may apply. To opt out, reply STOP. For assistance, reply HELP.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

12. Entire Agreement

These Terms, together with the Booking & Payment Policy and any policies referenced herein, constitute the entire agreement between you and the Company regarding website use and services.
